Liability Waiver

Waiver Agreement For Day Excursions, Island Hopping, Bar Hopping, Charter Boats, Fishing, and Water Sports Please read carefully. This is a legal and binding agreement. By signing this waiver, I understand and agree that I am giving up my right to sue D Squared Enterprises Ltd., Palm Cay, their owners, employees, agents, crew, affiliated personnel, and all vessels (owned, operated, leased, borrowed, or chartered). These are referred to as "The Released Parties." I understand that I am signing this waiver in exchange for being allowed to participate in activities offered by The Released Parties. 1. Assumption of Risk I understand that boating, fishing, snorkeling, swimming, jet skiing, and all related water activities involve risks. These risks include, but are not limited to: • Rough seas and weather conditions • Slips, falls, and injuries while boarding or exiting boats • Equipment failure • Injuries from marine life or land animals (bites, stings, etc.) • Injuries caused by fishing equipment • Accidents caused by other participants • Activities on docks, beaches, or activity sites • Transportation by boat, tender, or boat-to-boat transfers I knowingly and willingly accept all risks, whether listed here or not, whether foreseeable or unforeseeable. 2. Release of Liability I agree that I will not hold The Released Parties responsible for any injury, illness, death, or property damage that happens to me while participating in any activity, even if it is caused by negligence. This includes, but is not limited to: • Back, neck, or spinal injuries • Injuries caused by rough seas • Medical emergencies • Accidental injuries of any kind I promise not to sue or make any legal claim against The Released Parties for anything that may happen to me during or related to the excursion, including pre-boarding and after disembarkation. 3. Medical Acknowledgment I confirm that I am physically fit to participate in all activities offered, including boating, fishing, snorkeling, swimming, and water sports. I understand that: • Boats have limited medical facilities • Medical treatment may be delayed • Emergency care may require transport to a dock or medical facility I accept these conditions and the risks involved. 4. Rescue and First Aid I understand that The Released Parties make no guarantee that they can safely rescue or provide medical aid. If assistance or first aid is attempted, I agree not to hold them responsible for the outcome. 5. Alcohol Consumption I understand that alcoholic beverages may be offered during activities. I accept full responsibility for my own actions and release The Released Parties from any liability related to intoxication or impairment. 6. Full Release and Agreement I understand that this waiver: • Releases all The Released Parties from liability • Covers injuries, property damage, or wrongful death • Applies even if caused by negligence • Applies to me, my heirs, family, and legal representatives This is a complete and final agreement. I understand that I am giving up important legal rights. 7. Governing Law Any dispute related to this agreement will be governed by the laws of The Commonwealth of The Bahamas. 8. Photo & Marketing Permission I give D Squared Enterprises Ltd permission to take and use photos or videos of my experience for marketing purposes only. My personal information will not be shared. 9. Minors I acknowledge: • The minimum age to snorkel is 10 years • A parent or guardian must accompany minors I certify that I am the parent or legal guardian and agree to this waiver on behalf of myself and my child(ren). I release and agree to hold harmless The Released Parties to the fullest extent permitted by law, even if arising from negligence.
